Beschreibung This case, which is on review before the Commission for a second time, involves a twenty-item serious citation issued to L & L Painting Company, Inc. (“L&L”) following an inspection of its worksite on the New York side of the George Washington Bridge (“the Bridge”) by the Occupational Safety and Health Administration (“OSHA”). OSHA initiated the inspection after being notified by the New Jersey Department of Health and Senior Services that L&L employees working at the Bridge had elevated blood lead levels (“BLLs”). In the citation, OSHA alleged violations of the Occupational Safety and Health Act of 1970 (“the Act”), 29 U.S.C. §§ 651-678, primarily under the lead in construction standard, 29 C.F.R. § 1926.62.
